Membership Terms & Conditions

Welcome to 'The Savvy Hotel Marketer Membership' (“Membership”) - an online training programme developed for marketers/marketing teams working for independent hotels or resorts within Asia Pacific (for simplicity, “hotels”).  

Our mission is to support the professional development and success of hotel marketers, through offering unique marketing training and resources written for application in independent hotels, accessible anytime, anywhere, on our dedicated learning platform (hereafter referred to as the "Membership Platform").

By subscribing to the Membership, you confirm that you have read, understood, and agreed to be bound by these terms and conditions.

We wish to offer the best value in making your membership account available to your entire marketing team so we trust you to respect this and not share the membership Content with other hotels or elsewhere externally.

1.         Subscription Process

Each hotel is required to sign up for one account to access the Membership Platform (“Account”).  

To create an Account, you will need a generic email address that represents your hotel (which can be an email that comes with a distribution list). This email address serves as the primary identifier for your hotel in our system. Your hotel is also required to assign a contact person (likely the Hotel General Manager and provide us with his or her contact information for correspondence purposes. The hotel is responsible for ensuring that we have the current contact person’s name and contact information. To update the contact person’s information, please send us an email at support@savvyhotelmarketer.com.

Please note that the Membership subscription is for each hotel marketing team of up to six members (the team shall be referred to as the “Marketing Team” and each team member a “Participant”; “you” means the hotel and the Participant) to access the training and resources using an individual login credential to be set-up after the hotel Account is created. The Hotel General Manager will also be granted access to the Membership Platform. If the hotel has a Marketing Team exceeding this size or it is a central marketing team covering more than one hotel, one or more additional subscriptions, or purchasing additional indiivudal team member access if less than six extra members) will be required (as the case may be).  At this time individual marketers are not able to join the Membership, however  if interested, they may contact us by email at support@savvyhotelmarketer.com to discuss other learning options that may be acessible.

IMPORTANT: Each Account is intended exclusively for the Marketing Team of the hotel which registers the Account. We understand the passion you share with your fellow marketers, but sharing your Account with other hotels, even those affiliated or within the same group, is not allowed.

We understand that each hotel is unique, and exceptions may be necessary. If you believe that your hotel should be granted an exception to this rule, please reach out to us by email at support@savvyhotelmarketer.com with your reasons and we will consider them carefully. Our decision on this matter will be final and subject to our sole judgment.

Please note, Membership is open to hotels that are independent hotels and resorts (not affiliated with global and regional hotel groups, including franchise hotels) and located in countries within the Asia Pacific region. The Membership is designed to offer marketing skills learning to hotels that are not supported by centralised group hotel brand marketing teams that conduct a share of the marketing activities on behalf of the hotel. We reserve full right and discretion to decline any hotel from joining the membership should they not meet this hotel profile criteria. Our decision on this matter will be final and subject to our sole judgment.

 

2.         Account Management

Your hotel’s Account is the hotel’s property and responsibility and it is crucial to keep it protected. We strongly recommend changing Account passwords regularly and reviewing the current team member access (especially when a Marketing Team member with account access leaves your hotel) to ensure this is accurate.  This simple habit will help prevent unauthorised access. We may email the Account contact person regularly, to confirm the current list of Marketing Team members who have access is accurate. The hotel is responsible for ensuring that the Account is always used by members of its Marketing Team and members who left its Marketing Team shall NOT have access to the Account.

A hotel, as the Account owner, bears the ultimate responsibility for all activities conducted via the Account, whether by authorised or unauthorised individuals.

We encourage all our Participants to respect our Membership's integrity. We hold the right to suspend or cancel any Account, without refund or compensation, if we identify activities that suggest suspicious Account sharing.

3.         Membership Content

The Membership provides access to the Membership Platform which contains a variety of materials for marketers to develop their skills, including toolkits, templates, checklists, video lessons (live or recorded), handouts, monthly group online calls, etc. These materials may be in the form of text, diagrams, videos, audio or other media (“Membership Content”).

One new marketing training lesson as part of the Membership Content is provided on a monthly basis. Additional bonus trainings and other Membership Content may occasionally be made available for extra learning value and market relevance.  The order of delivery of the Membership Content will be determined by us with regard to factors such as seasonality, guest trainers and relevant industry occurrences.

All Membership Content is exclusive to the Marketing Team of hotels with a valid Membership at the time of access. It is important to note that among the Membership Content, no downloading is permitted for all video and audio files by any Participant. Toolkits, workbooks, templates and other materials marked as ‘downloadable’ may be downloaded and used in accordance with these terms and conditions.

Please be aware that we hold complete discretion to withdraw, rearrange, modify, or update the Membership Content. We aim to provide the most useful and up-to-date resources for our Participants, so changes can occur without prior notice.

4.         Group Online Calls

There will be regular group online coaching and Q&A calls among Participants to be held monthly and occasionally from time to time (“Group Online Calls”) for a particular marketing skill, action or strategy which a hotel marketer needs to learn or develop skills. 

Call times will be communicated as set out in Clause 13 below.  Members of the Marketing Teams may participate in the Group Online Calls at their wish. However, please note that there shall not be any refund, re-run or re-scheduling of any Group Online Calls if any Participant fails to join any of the Group Online Calls. Whilst we strive to accommodate Participants in different time zones, it may not be always possible. Where appropriate, we will make recordings of these Group Online Calls available for the Participant’s viewing afterwards for a limited period of time.

Group online calls allow Participants to discuss, exchange views and knowledge sharing. We will moderate the discussion and provide feedback and insights on discussions. No Participant shall use the Group online calls as a platform for the promotion of products or services or for any commercial purposes or for spreading any messages unrelated to the subject matter intended to be discussed.

All information shared and disclosed by any Participant during any Group Online Calls would be deemed non-proprietary and become public data, which may be used by anyone without further consent from the Participant or hotel.  If any Participant decides to disclose information of a confidential or proprietary nature during any Group Online Calls, such Participant will do so at his/her own risk and we shall not be responsible for held liable for any unauthorised use of such information by anyone.

Each Participant agrees not to behave, make comments, suggestions or views or share information during any Group Online calls that, in our sole opinion:

  • are illegal, defamatory, pornographic, fraudulent, harassing, inappropriate, offensive, racist, sexist, arousing hatred, abusive, threatening or otherwise objectionable defamatory; or

  • consist of vulgar, profane, crude, violent or hostile language or swearing; or

  • infringe our intellectual property rights or any other rights of ours or any third party.

Views, opinions and/or statements of any Participant shall be taken as his/her personal views, opinions and/or statements. They do not represent and should not be taken to represent or indicate: (i) our stance, views, or opinions; (ii) and/or our endorsement of any products, services or persons related to such Participant. We shall not be liable for any loss, damage, or cost, whether direct or indirect, suffered by any one as a result of any reliance on such views, opinions or statements.

By participating in any such Group Online Calls, you grant us the right to record these Meetings and to publish such recordings (in whole or in part) on the Membership Platform. This allows Participants who may have missed the Meeting to view it at their convenience. Additionally, you agree that we may utilise these recordings (or any portion thereof) in any media or formats across the globe without the necessity of obtaining further consent from you or providing compensation.

We reserve full right and discretion to remove any Participant from any Group Online Calls who violate any of these terms and conditions without any liability or prior notice.

5.         Intellectual Property Rights Protections

You acquire no rights in or to the Membership Platform and the Membership Content by accessing our Membership other than the limited right to use the Membership Platform under a valid Account and to download on the terms set out in this section.

You retain all intellectual property rights in the information you contributed in the course of the Membership (if any). However, by contributing, you grant us a perpetual and free license to use, modify, and adapt this information for any purpose.

Unless expressly permitted by us, you are not permitted to copy, distribute, modify, or exploit any part of the Membership Content.

Participants may download the Membership Content that is marked as ‘downloadable’.  Any downloads should retain all copyright notices and should not be sold or distributed further, whether for profit or not. It is important to note that among the Membership Content, no downloading is permitted for all video and audio files by any Participant and toolkits, templates and other materials marked as ‘downloadable’ may be downloaded and used in accordance with these terms & conditions.

If you provide feedback to us via the Membership Platform, it is deemed non-confidential and non-proprietary. You agree to grant us the right to use this feedback without any compensation to you.

6.         Membership Plans and Duration

To activate a new Account with our Membership, your hotel may subscribe on a monthly or annual subscription plan.

If you subsribe on the monthly subscription plan, your subscription continues on a monthly basis. You are able to unsubscribe at all time. To unsubscribe, please contact us by email at support@savvyhotelmarketer.com at least 5 days prior to the end of the current subscription period (i.e. on or before the 25th day of a month for a 30-day month), failing which, a monthly subscription fee will be charged at the prevailing rate, and the subscription shall remain effective until the end of the month.

If you subscribe on the annual subscription plan, given the savings this annual payment plan offers, you are not able to unsubscribe before the end of the full subscription year.  If you wish to unsubscribe before your annual subscription renews at twelve months, please contact us by email at support@savvyhotelmarketer.com at least 5 days prior to the end of the current subscription period (i.e. on or before the 25th day of a month for a 30-day month), failing which, an annual subscription fee will be charged at the prevailing rate, and the subscription shall remain effective until the end of the following year.

In no circumstances we will refund any paid subscription fees for any intended termination of subscription not following this clause or the Marketing Teams’ decision not to access the Membership Platform or any parts thereof during the subscription period.  We do not accept any request to suspend or defer a Membership.

We also periodically offer different subscription plans and special promotions, the terms of which will be determined by us at our discretion.

7.         Founding Member

Those hotels joining the Membership when the Membership first launchs on 27 March 2024 (“Initial Launch”), will be recognised as a ‘Founding Member’. The hotel will receive a notification from us by email if it attains the status of a Founding Member after the full payment of subscription fees.

The term of the Founding Member commences from the date of the notification and three years after such date (inclusive of both days) ("Term”).

A Founding Member will enjoy the same subscription rate as of Initial Launch for the entire the Term (“Founding Member Rights”). However, if the Membership terminates at any time during the Term in accordance with the terms and conditions, the status of “Founding Member” and the Founding Member Rights shall be permanently terminated at the same time. The status of “Founding Member” will not be reactivated and the Founding Member Rights will not be rewarded to any former Founding Member who later signs up the same hotel or a new hotel for the Membership again. The Founding Member status is assigned to the hotel which joins the Membership, not to the General Manager who signs up the Founding Member hotel.

The status of “Founding Member” and the Founding Member Rights may not be sold, assigned, transferred, conveyed, gifted, exchanged, licensed or otherwise disposed of without our prior written consent.

8.         Recruitment Model

Our Membership recruits periodically and involves alternating phases of open and closed membership periods throughout the year.

In an open period, hotels that have registered interest and meet the Membership hotel profile, will be invited to join our Membership. Following this, we will close enrolment for a certain period, weeks, or months. This exclusive membership model allows us to provide a focused, high-quality onboarding experience for each cohort of Participants.

This cycle repeats several times a year at a frequency and length to be determined by us at our discretion, providing multiple opportunities for interested hotels to join our Membership.

The exact timing of these open and closed periods is determined solely by us. We encourage you to keep an eye out for our announcements or register your interest, so you do not miss your chance to join.

9.         Termination

We reserve the right to suspend or terminate any Account under certain conditions. While we hope we never have to take such measures, it is essential that we maintain a harmonious and respectful Membership for all participants. These conditions include:

  • If the Account is found to be not abiding by these terms and conditions, or breaching any applicable laws;

  • If we suspect that the Account is being used for any unlawful activities;

  • If the Account does not meet its subscription fee obligations in a timely manner;

  • If the Account shares Membership Content that is unlawful, harassing, political, potentially infringing, vulgar,  defamatory, invasive of someone else's privacy, hateful, offensive, contains sensitive words or is otherwise deemed inappropriate by us; and

  • If the Account is interfering with or disrupting the operation of our Membership or creating a negative impact on other Participants.

Remember, we are all here to learn and grow together. Your cooperation in maintaining a positive and enriching learning environment is greatly appreciated.

10.       Effect of Termination

Once terminated, the Account will be closed and you will not be able to access the Membership Platform or any previously accessible Membership Content.

11.       Payment / Pricing

All payments for our Membership are securely processed through a third-party payment processing services provider we engaged specially for the Membership Platform. By commencing a payment, you confirm that you have read, understood, and agreed to such third-party's terms and conditions, and you authorize them to handle your payment information.

For any renewed subscriptions, the subscription fees will be charged automatically from the credit card provided to us at the time of registration on the first business day of the next subscription period. To terminate the Membership, please refer to Clause 6 above.

We retain the right to adjust subscription prices periodically. These changes will be communicated to you in advance as set out in Clause 13 and be effective from a time to be stipulated in such notice.  Any changes to the subscription prices aim to reflect the evolving value and Membership Content we provide in our Membership.

In no circumstances we will refund any paid subscription fees for any intended termination of subscription not following this clause or the Marketing Teams’ decision not to access the Membership Platform or any parts thereof during the subscription period.  We do not accept any request to suspend or defer a Membership.

12.       Disclaimer

The Membership is provided "as is" excluding any guarantees, conditions, or warranties of any kind, either express or implied, to the fullest extent permitted by applicable laws. These exclusions include but are not limited to, the warranties of satisfactory quality or fitness for a particular purpose and non-infringement of third-party rights.

We do not warrant that:

  • the accuracy, completeness, timeliness, usefulness and suitability of the Membership Content;

  • any learning results or duration required for achieving any intended results is guaranteed;

  • the Membership Content will perfectly suit each hotel’s needs or achieve your intended purposes or results. The Membership Content is for educational and informational purposes only and shall not be relied upon as a basis for making any legal or business decisions;

  • access to our Membership or any part of it (including the Membership Content) will be uninterrupted, reliable, virus-free or error-free;

  • our Membership Platform will be compatible with all types of devices or software for access;

  • we have the title in the Membership Content and that the Membership Content is original or non-infringing;

  • any of our Membership Content available at one time will always be available; and

  • the security of any information which you transmit to us.

IMPORTANT: The Membership Content or advice provided through the Membership should not be considered business, legal or professional advice. We disclaim all liabilities arising from the use or implementation of the Membership Content and information disseminated in the course of our Membership.

13.       Limitation of Liability

To the maximum extent allowed by law, we disclaim all liability and will not be responsible for any  direct, indirect, or consequential losses or damages you or any other person may suffer (including without limitation, damages for lost profits, lost data, loss of goodwill, loss of business opportunity, work stoppage, computer failure or malfunction, or any other commercial damages or losses, personal injuries, even if we had been advised of the possibility thereof) due to:

  • any technical, factual, textual, or typographical inaccuracies, errors or omissions within the Membership Content;

  • your reliance on the Membership Content, information or materials contained or disseminated via the Membership;

  • the unavailability of our Membership or any part of it;

  • any delay in the delivery of, failure to provide, or negligent provision of our Membership or any of its Membership Content.

In any case, our liability to you for each occasion will not exceed a total of US$100.

14.       Communications

Our primary method of communication with you will be through the designated email address you provide at the time of Account creation, or via announcements posted directly on the Membership Platform.

Any communication sent to your designated contact emails or posted on the Membership Platform will be considered as having been properly given and received. The designated contact person of each hotel shall be responsible for ensuring all members of the Marketing Team receive our messages. Please ensure your provided email addresses are current and checked regularly to stay updated on all communications.

15.       Dispute Resolution

You agree to settle any disputes with us first by way of negotiation.

Any dispute, controversy, difference or claim arising out of or relating to these terms and conditions, including the existence, validity, interpretation, performance, breach or termination thereof or any dispute regarding non-contractual obligations arising out of or relating to it shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (“HKIAC”) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The law of this arbitration clause shall be Hong Kong law. The seat of arbitration shall be in Hong Kong. The number of arbitrators shall be one. The arbitration proceedings shall be conducted in English. Any unresolved disputes, claims or actions arising from the Membership should be finally resolved by way of arbitration at HKIAC.

16.       Membership Changes/Cancellation

We reserve the right to modify, remove, or otherwise alter any Membership Content or aspect of the Membership Platform (including without limitation, the look-and-feel of the Membership Platform, the mode of delivery of Membership Content, the hosting website or software, etc.), or to terminate the Membership itself, at any time, at our sole discretion. Furthermore, we may revise these terms and conditions from time to time, with the updated version taking effect upon its publication on the Membership Platform.

17.       Language

The medium of language used for the Membership Platform, Membership Content and Group Online Calls and all aspects of the Membership is English. No translation will be provided by us. Without our prior written consent, you may not translate any content of our Membership Platform (including the Membership Content) into any other languages.

18.       Assignment

Membership may not be sold, assigned, transferred, conveyed, gifted, exchanged, licensed or otherwise disposed of without our prior written consent.

19.       Third-party rights

Nothing in these terms and conditions confers or purports to confer on any third party any benefit or any right to enforce these terms and conditions pursuant to the Contracts (Rights of Third Parties) Ordinance (Cap. 623).

20.       Changes to our Terms and Conditions

We may amend these terms and conditions from time to time by posting the updated terms and conditions on our website www.savvyhotelmarketer.com (“Site”) and/or our Membership Hub. By continuing to use our Site and/or Membership Hub after the changes come into effect means that you agree to be bound by the revised terms and conditions.

21.       Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”). Any dispute or claim arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
